Welcome to Launchsub ("Launchsub", "we", "our", or "us").

These Terms of Service ("Terms") govern your access to and use of Launchsub, including our website, applications, APIs, Discord bot, and any related services (collectively, the "Services").

By creating an account, accessing, or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use Launchsub.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use Launchsub.

By using our Services, you represent and warrant that you have the legal authority to enter into this agreement.

2. Your Account

You are responsible for:

• Maintaining the security of your account.
• Keeping your login credentials confidential.
• All activities that occur under your account.
• Providing accurate and up-to-date information.

Launchsub is not responsible for unauthorized access resulting from your failure to secure your account.

3. Our Services

Launchsub provides software that allows creators and businesses to sell subscriptions and automate access to communities and digital services.

We may modify, improve, suspend, or discontinue any feature at any time without prior notice.

We do not guarantee uninterrupted availability of the Services.

4. Payments

Launchsub does not process payments directly.

Payments are processed through third-party payment providers such as Stripe.

By using Launchsub, you also agree to comply with the terms and policies of your chosen payment provider.

Creators are solely responsible for:

• Managing their payment accounts.
• Refunds.
• Chargebacks.
• Taxes.
• Compliance with local laws.

Launchsub automatically deducts platform fees according to the subscription plan selected by the creator.

5. User Content

You retain ownership of all content you upload to Launchsub.

You grant Launchsub a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and display your content solely for the purpose of operating, improving, and providing the Services.

You represent that you own, or have all necessary rights to use, distribute, and publish your content.

You are solely responsible for all content published through your account.

6. Prohibited Uses

You agree not to:

• Violate any applicable law.
• Attempt to hack, disrupt, or damage Launchsub.
• Reverse engineer our software.
• Circumvent security measures.
• Upload malicious software or viruses.
• Use the Services to distribute illegal, fraudulent, hateful, or abusive content.
• Spam users or send unsolicited communications.
• Infringe the intellectual property rights of others.
• Use Launchsub for money laundering, fraud, or illegal financial activities.

Launchsub reserves the right to determine what constitutes prohibited conduct.

7. Intellectual Property

Launchsub and all associated software, branding, trademarks, designs, graphics, logos, and content are owned by Launchsub or its licensors.

Nothing in these Terms transfers ownership of any intellectual property to you.

8. Third-Party Services

Launchsub integrates with third-party services including payment providers, Discord, analytics providers, cloud hosting providers, AI providers, and other external services.

We are not responsible for the availability, functionality, policies, or actions of third-party services.

Your use of those services is governed by their respective terms.

9. Fees

Subscription fees are billed according to the pricing displayed on Launchsub.

Platform transaction fees are deducted automatically where applicable.

Launchsub reserves the right to modify pricing at any time.

Price changes do not affect subscriptions already paid for until their renewal date.

10. Refunds

Unless otherwise required by applicable law, Launchsub does not issue refunds for subscription fees paid to Launchsub.

Creators are solely responsible for refund requests relating to products or subscriptions they sell.

11. Availability

We strive to provide reliable Services but cannot guarantee:

• Continuous uptime.
• Error-free operation.
• Compatibility with every device.
• Availability of third-party integrations.

Maintenance, outages, updates, or force majeure events may temporarily interrupt the Services.

12. Suspension and Termination

Launchsub may suspend, restrict, or permanently terminate your account at any time if:

• You violate these Terms.
• You engage in fraudulent or illegal activity.
• You abuse the platform.
• Your use creates legal or security risks.
• We are required to do so by law.

Termination does not relieve you of any outstanding payment obligations.

13. Disclaimer of Warranties

The Services are provided "AS IS" and "AS AVAILABLE."

To the fullest extent permitted by law, Launchsub disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, and reliability.

14. Limitation of Liability

To the fullest extent permitted by law, Launchsub, its owners, employees, contractors, affiliates, and partners shall not be liable for any indirect, incidental, consequential, punitive, or special damages, including loss of profits, revenue, customers, goodwill, business opportunities, or data arising from:

• Your use of the Services.
• Service interruptions.
• Third-party services.
• Payment disputes.
• Unauthorized account access.
• Cyberattacks.
• Data loss.
• Software bugs.
• Force majeure events.

Our total liability shall never exceed the amount you paid to Launchsub during the twelve (12) months preceding the event giving rise to the claim.

15. Indemnification

You agree to defend, indemnify, and hold harmless Launchsub and its affiliates from any claims, damages, liabilities, losses, costs, or legal expenses arising from:

• Your use of the Services.
• Your content.
• Your violation of these Terms.
• Your violation of any law or third-party rights.

16. Privacy

Your use of Launchsub is also governed by our Privacy Policy.

17. Changes to These Terms

We may modify these Terms at any time.

Updated Terms become effective immediately upon publication unless otherwise required by applicable law.

Your continued use of Launchsub constitutes acceptance of the revised Terms.

18. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws applicable to the jurisdiction in which Launchsub operates, without regard to conflict of law principles.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy and any additional legal policies published by Launchsub, constitute the entire agreement between you and Launchsub regarding the Services.
